Affiliate & Referral Programme Policy

This Affiliate & Referral Programme Policy (the “Policy”) is a binding agreement between you and BeTheGuests (“we”, “us”, the “Platform”). By joining the affiliate programme, generating or sharing a referral link or code, or accepting any commission, discount or reward under either programme, you confirm that you have read, understood and agree to be bound by this Policy in full.

• You must be at least 18 years old and legally able to enter into contracts.
• You must hold a registered account with accurate, current information.
• Participation is personal and non-transferable. You may not sell, lease or share your affiliate account or links with third parties.
• We may refuse, limit or revoke participation for any person, at any time, at our sole discretion, without obligation to give reasons.

Commission rates, referral discounts, attribution windows, holding periods and minimum payout thresholds are displayed in your affiliate dashboard and may be changed by us at any time, with immediate effect, without prior notice. Changes apply to all bookings made after the change takes effect.

• Commission accrues only on completed, fully paid bookings genuinely attributable to your link or code under our tracking rules. Our tracking records are the sole and conclusive evidence of attribution.
• Commission is held as “pending” until after the experience date and applicable cancellation windows have passed. Cancelled, refunded, charged-back, disputed or undelivered bookings accrue no commission, and any commission already credited for them will be reversed — including from future earnings.
• Participation is not employment, agency, partnership or franchise. You are an independent party responsible for your own taxes, social charges and regulatory compliance in your jurisdiction.
• We make no guarantee of earnings of any kind. Estimates, calculators and examples shown anywhere on the Platform are illustrative only.

• Referral discounts are for genuine new customers. Claiming a referral discount requires creating and verifying an account.
• Referral codes and welcome offers are strictly single-use per person (by account, email address, payment method and/or household, as determined by us) and cannot be combined with other offers unless we expressly say otherwise.
• Self-referral is prohibited: you may not use your own link, code or reward to discount your own purchases, including through accounts you control or purchases made on your behalf.
• We may void any discount, cancel any resulting booking, and recover any value obtained where we reasonably believe these rules were broken.

The following (non-exhaustive) conduct results in immediate termination and forfeiture of all unpaid amounts:

• Fraud, misrepresentation, or the creation of fake accounts, fake bookings or artificial transactions of any kind.
• Self-referral, cookie stuffing, forced clicks, misleading redirects, iframe loading, or any manipulation of the tracking system.
• Bidding on our brand name (or misspellings) in paid search, or using our brand in domain names, handles or usernames without written permission.
• Spam of any form — unsolicited bulk email, comment spam, message-board flooding, or unsolicited direct messages.
• Presenting yourself as us, as our employee or agent, or making promises on our behalf (including about prices, availability or refunds).
• Promoting your link in connection with unlawful, deceptive, hateful, adult or otherwise objectionable content.
• Offering unauthorised cash-back, rebates or incentive schemes funded from your commission without our written consent.

You are solely responsible for complying with all advertising and consumer-protection rules that apply to you, including the FTC Endorsement Guides, the UK CAP Code, EU consumer law and any platform-specific rules (Instagram, TikTok, YouTube, etc.). In particular, you must clearly and conspicuously discloseyour material connection to us (e.g. “#ad”, “affiliate link — I earn a commission”) wherever you share your link. You agree to indemnify us for any claim arising from your failure to do so.

We may withhold, suspend, reverse or cancel any commission, reward, discount or payout — before or after it becomes payable — where we reasonably suspect breach of this Policy, fraud, abuse, chargeback risk, or error. We may investigate for up to 180 days before releasing withheld amounts. We may offset any amount you owe us (including reversed commissions and our reasonable investigation costs) against any amount we owe you. Balances below the minimum payout threshold, and balances on accounts terminated for breach, are forfeited.

We grant you a limited, revocable, non-exclusive licence to use our name, logo and approved creative assets solely to promote the Platform while you remain in the programme. All goodwill accrues to us. The licence ends automatically when your participation ends, and we may revoke it at any time. You must not alter our marks, register anything confusingly similar, or use them in a way that harms our reputation.

• Either party may end participation at any time. You can stop sharing your link; we can suspend or terminate your participation at our sole discretion, with or without cause, effective immediately.
• On termination without breach, validly accrued and matured commissions above the payout threshold will be paid in the normal cycle; everything else lapses.
• On termination for breach, all pending and payable amounts are forfeited without compensation.
• We may amend this Policy at any time by posting the updated version on this page. Continued participation after posting constitutes acceptance. Material changes take effect immediately for new activity.

The programmes are provided “as is” and “as available”. We do not warrant uninterrupted tracking, availability of any product, or any particular conversion rate. To the maximum extent permitted by law: (a) we exclude all liability for indirect, incidental, special or consequential losses, lost profits and lost data; and (b) our total aggregate liability to you arising out of or relating to either programme is limited to the total commissions actually paid to you in the three (3) months preceding the event giving rise to the claim. Nothing in this Policy excludes liability that cannot lawfully be excluded.

You agree to indemnify, defend and hold us (and our officers, employees and partners) harmless from any claim, demand, loss, cost or expense — including reasonable legal fees — arising out of your promotional activity, your content, your breach of this Policy, or your violation of any law or third-party right.

• This Policy is supplemental to our Terms of Service and Privacy Policy; in a conflict about the programmes, this Policy prevails.
• Our failure to enforce a provision is not a waiver. If a provision is held unenforceable, the remainder stays in force.
• You may not assign your rights under this Policy; we may assign ours to a successor of the business.
• Our decisions on attribution, commission calculation, fraud and abuse are final and binding to the extent permitted by law.
